Terms & Conditions applicable to Participants in the "Happiness Store" Campaign 2010 (the "Competition")
1. The Happiness Store Campaign (‘Competition’) is a promotion being organised under the My Coke Star Points Loyalty Program (the "Program"). The Program is a loyalty program organised by The General Soft Drinks Co Ltd (the "Organisers") through which individuals can collect points by purchasing participating Coca-Cola Products that will contain a code underneath the label, (the "Code") available while supplies last, or through other methods as may be added from time to time.
2. The Competition begins on the 21st January 2010 and will remain valid until stocks last (the "Promotion Period"). The Organisers reserve the right to shorten, extend, suspend, modify or cancel the Competition at its discretion and at any time.
3. All terms and conditions of the Program (‘Program T&Cs’) shall apply to the Competition in addition to the terms and conditions stipulated below (the Competition T&Cs’). All capitalised terms used in the Program T&Cs shall, unless otherwise defined herein, bare the same meaning in the Competition T&Cs’.
4. By completing the procedures contemplated in these Competition T&Cs, participants signify their consent to the terms and conditions set forth herein and agree to fully comply therewith. These Competition T&Cs shall constitute an agreement between the Organisers and the Participants.
Participation in the Program
5. In order to participate in the Competition, Participants must have enrolled on the Program and must have created an account as detailed in the Program’s T&Cs and on www.mycoke.com.mt (the "Website"). Prizes within the Happiness Store can only be redeemed via the website. Prizes cannot be redeemed via SMS.
6. Throughout the Promotion Period, individuals may participate in the Competition in the following manner: individuals can visit www.mycoke.com.mt, (the "Website"), or text message the Code with a text-messaging capable device to +356 99180022 (the "Participation Number") in order to have their accounts credited with the points they have collected. Individuals who credit their accounts via text-messaging will be charged at standard rates or preferential rates imposed by local mobile phone operators, if and when applicable.
7. As from the 18th of January 2010, Points received will be colour-coded, according to the product on which the code submitted was printed. Thus, Participants submitting Codes from the following Products (including 1.5 Litre or 0.5 Litre PET bottles) will receive coloured points as follows:
• Coca-Cola: Red Star Points
• Coca-Cola Zero: Black Star Points
• Diet Coke : Silver Star Points
• Fanta Orange, Fanta Lemon, Fanta Amara, Fanta Zero & Dr.Pepper: Orange Star Points
• Sprite & Sprite Zero: Green Star Points
Collectively referred to as "the Coloured Star Points".
8. Any coloured points collected in terms of the Program (or any other promotion organised by the Organiser in terms of the Program), prior to the 18th of January 2010, which were not redeemed against prizes, will remain valid and will be converted into coloured star points according to the original product on which the Code submitted was printed (as per point 7 above)
9. The Happiness Store shall list all the items that may be redeemed and the corresponding number/ colours of points which are required to redeem each prize.
10. The items that may be redeemed shall be subject to availability by the Organisers.
Redemption of Star Points and Prizes
11. Participants having collected sufficient coloured points in their account to redeem a particular item found in the Happiness Store, may proceed to redeem the item against their star points using the REDEEM NOW function. Each Enrolee may only use the REDEEM NOW function for a maximum of one prize in the Sprite Zone Promotion every 20 days.
12. If Participants do not have the required points to redeem a particular item on the Website, they may avail themselves of the opportunity to reserve the item by placing it in a section of the Website entitled the ‘Wish List’. Each Enrolee may only place one item per 28 days in his/her WISHLIST at any one time across all categories within the MyCoke Star Points Program.
13. Once an item has been placed in the Wish List, Participants shall be notified via the Website of the number of days within which the item must be redeemed. In the event that the Participant does not collect enough points and redeem the reserved item in the prescribed number of days (the ‘Reservation Period’), such reservation shall fall. Such item shall become available for redemption to other Participants and will be removed from the Participant’s Wish List.
14. Any individual who has any unclaimed item in his or her Wish List will not be entitled to add any further Items to his/her Wish List or redeem any other item until the item is redeemed/ the reservation period has expired and 28 days have passed from the initial reservation.
15. An individual may only redeem a maximum of one item at a time and once an item is redeemed, the individual must wait at least 28 days to redeem another item or to place another item on his or her Wish List.
16. All redemptions for items of the Happiness Store are final. Refunds, exchanges and other issues are governed by the terms and conditions applicable to the purchase and sale of the particular item from the supplier of the item and are not the responsibility of the Organiser.
17. The Organiser reserves the right to modify the available items for redemption and corresponding total number of points at any time during the Competition, at its own discretion and without notice and liability to Participants.
Delivery and Collection of Items
18. Participants may choose to collect the redeemed items themselves from the outlets indicated by the Organiser, (The "Collection Option") at the time and place stipulated by the Organisers and notified to the Participants. Alternatively, Participants may request that the redeemed item be delivered at their preferred address by the Organisers or persons appointed by the Organisers. ("Home Delivery Option").
19. In the event that Participants would like to make use of the Home Delivery Option, they will be charged a fee ranging between 2.50 to 5.00 Euros per item, ("Home Delivery Charge") depending on the points value of the redeemed item. Participants will be notified of the Home Delivery Charge before confirming redemption and the Home Delivery Option.
20. When confirming the Home Delivery Option, the participant will be asked to confirm the address at which such delivery shall take place. (The "Preferred Delivery Address")
21. Home Deliveries in Malta will be made between Monday and Friday between 8:30am and 5.00pm and those in Gozo will be held on Tuesdays only between 9:30am and 3:30pm to the Preferred Delivery Address.
22. The Home Delivery Charge is payable on receipt of item.
23. Should the participant not be present when the item is delivered, a note would be left detailing information relating to the location and days and time in which the participant will be required to collect the item. Collection following unsuccessful delivery will be at no charge to the participant. Only one Home Delivery attempt will be made per item.
24. Should any individual unreasonably refuse any charges for an item delivered by courier after opting for the "Home Delivery Option", the item and any points exchanged for said item will be forfeited. Moreover the said participant will be deemed to be a prohibited participant and will not be able to participate in the Competition or in the Program further for a period of time to be defined by the Organisers.
25. For those Participants that have chosen the delivery option, the items will be delivered to the Preferred Delivery Address within a maximum of 20 working days from the online redemption date.
26. For those Participants that have chosen to collect the item themselves, the item would be ready for collection within a maximum of 15 working days from the online redemption date.
27. The Organisers shall not be liable for any reasonable delays in the delivery of the Happiness Store items redeemed.
28. Collections from MALTA are to be made from Aramex Logistics Unit 6&7, off/Triq San Gwakkin, Mriehel Industrial Estate, Mriehel (TEL: 23984000).
29. MALTA Collections may be done ONLY on TUESDAYS and THURSDAYS between 9am and 6pm.
30. Collections from GOZO are to be made from The General Soft Drinks Distribution Centre, Vincenzo Caruana Spiteri Street, Sannat , Gozo (TEL: 22291730).
31. GOZO Collections may be done between Monday and Friday between 8:30am and 12pm.
32. When collecting their items from the respective outlet, Participants must present their Identity Cards and Redemption Codes at the respective location and on the respective dates, as specified on the notification received confirming redemption of the items.
General Terms and Conditions
33. The Competition will be run in accordance with these terms and conditions and in accordance with the Program’s T&Cs, subject to any amendment which may by made from time to time by the Organisers at their sole discretion.
34. The participants of the Competition must abide with these terms and conditions and with the Program’s T&Cs.
35. These terms and conditions, as set out herein, are not subject to amendment or counter-offer, except as set out herein.
36. The Organisers reserve the right to cancel this Competition in its entirety without notice to Participants and without incurring liability
37. The Organisers are not responsible for any incorrect or inaccurate information supplied by individuals while participating in the Competition.
38. By entering this Program, each Participant consents to the use of his/her entry, name and address in any publicity carried out by the Organisers, without further compensation.
39. The Organisers shall collect the personal data of Participants in order to permit and facilitate participation in the Competition. By participating in the Competition Participants consent to the Organisers processing their personal details in accordance with the Data Protection Act (Cap 440 of the Laws of Malta). Except as otherwise provided in these terms and conditions, the Organisers will only disclose personal details if and when it is required to do so under any applicable law. Participants have the right to access data which the Organisers hold about them, and, where applicable, the right to ask for a rectification or erasure of such data.
40. The Organisers shall not be held liable in any way, for any claims arising out of or relating to the use of any of the items redeemed through this Competition, including but not limited to claims for personal injury or damage caused to the Participants or any other third party. Furthermore the Participants hold and continue to hold the Organisers free and harmless against all and any claims of any person in respect of the Happiness Store Prizes and their use. The Organisers are not liable for any damage suffered by any Participant due to the non observance of these Terms and Conditions.
41. The Organisers shall not be liable for any delays in the delivery of the items to Participants.
42. The Organisers are not responsible for any technical error that may occur during the Competition. This includes, but is not limited to, any omission, interruption, deletion, defect or delay in operation or transmission or failure of any telephone, mobile or satellite network.
43. The Organisers are not responsible for any tax implications that may arise from winning any prize pursuant to the Competition. Participants should seek independent financial advice about such matters.
44. All questions or disputes regarding eligibility of the Competition, collecting or redemption of points, or an Enrolee’s compliance with these Terms and Conditions will be resolved by the Organisers in their sole discretion. The Organisers shall not entertain ill-founded complaints or contestations made by the Participants.
45. An Enrolee’s continued participation in the Happiness Store constitutes the Enrolee’s acceptance of any changes to the full terms and conditions. Enrolees are responsible for remaining knowledgeable as to any changes that the Organiser may have made to these Terms and Conditions. The current full version of the Terms and Conditions is available on the Website and will supersede all other versions of the Terms and Conditions. (www.mycoke.com.mt)
46. The Competition is only made available under the Program and is not made available in conjunction with any other offer or promotion.
47. The Happiness Store Prizes offered in terms of the Happiness Store are non-transferable and can not be exchanged for cash.
48. As a condition of participating in this Competition Participants agree that
(a) any and all disputes, claims, and causes of action arising out of or connected with this Competition, of any prizes obtained through the Competition, shall be resolved individually, without resort to any form of cumulative or group action and exclusively by the Courts of Malta;
(b) any and all claims, judgments and Prizes shall be limited to actual out-of-the-pocket costs incurred, including costs associated with participating in this Competition, but in no event attorneys’ fees; and
(c) under no circumstances will the Participant be permitted to seek recovery for, and the Participant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses and waives any and all rights to have damages multiplied or otherwise increased.
49. All issues and questions concerning the construction, validity, interpretation and enforceability of these Competition T&Cs, or the rights and obligations of the Participant and Organiser in connection with the Competition, shall be governed by, and construed in accordance with, the laws of Malta without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than Malta.
50. These Competition T&Cs constitute the entire agreement between the Participants and Organiser pertaining to the subject matter herein and supersedes all prior or other arrangements, understandings, negotiations and discussions, whether oral or written. No waiver of any of the provisions of these Competition T&Cs shall be deemed or shall constitute a waiver of any other provisions hereof (whether or not similar), nor shall waiver constitute a continuing waiver unless otherwise expressly provided.

Sprite Refreshment Zone Terms and Conditions
1. The Sprite Refreshment Zone Promotion (the ‘Sprite Zone Promotion’) is a promotion being organised under the My Coke Star Points Loyalty Program (the “Program”). The Program is a loyalty program organised by The General Soft Drinks Co Ltd (the “Organisers”) through which individuals can collect points by purchasing Coca-Cola PET Products produced by The General Soft Drinks Co Ltd that will contain a code underneath the label, (the “Code”) available while supplies last, or through other methods as may be added from time to time. Individuals can then visit www.mycoke.com.mt, (the “Website”), or text message the Code with a text-messaging capable device to +356 99180022 (the “Participation Number”) to have their accounts credited with the points they have collected. Individuals who credit their accounts via text-messaging will be charged at standard rates or preferential rates, if and when applicable.
2. All terms and conditions of the Program shall apply to the Sprite Zone Promotion in addition to the terms and conditions stipulated below.
3. Individuals may exchange their Sprite Green points for O’Neill products available through the Website only. The redemption of prizes in the Sprite Promotion cannot be done by SMS.
4. The Sprite Promotion begins on 22 March 2010 and is scheduled to end on 31 May 2010 (the “Promotion Period”) or until stocks last, but the Organiser reserves the right to shorten, extend, suspend, modify or cancel the Program at its discretion and at any time. Individuals can collect green points by purchasing Sprite products and entering codes from Sprite 0.5litre or 1.5 Litre PET bottles produced by The General Soft Drinks Co Ltd. Codes may be entered at any time and individuals may collect points at any time throughout the Promotion Period and may redeem prizes between 22 April 2010 and 31 May 2010 (the “Redemption Period”).
5. Participants having collected sufficient Sprite Green points in their account to redeem a particular item found in the Sprite Refreshment Zone may proceed to redeem the item against their star points using the REDEEM NOW function.
6. Each Enrolee may only use the REDEEM NOW function for a maximum of one prize in the Sprite Zone Promotion every 20 days.

11. All point redemptions for products are final. Refunds, exchanges and other issues are governed by the terms and conditions applicable between the supplier/producer of the particular item and the Enrolee and are thus not the responsibility of the Organiser. Enrolees shall not be entitled to exchange any item or prize once it has been reserved following the redemption of points in the manner described in these terms and conditions and those of the Program. Enrolees are to ensure that when redeeming their prize, they choose the correct item and choose the correct details, including but not limited to details such as those of the colour and size of the item.
12. The Organiser reserves the right to modify the available items for redemption and corresponding total number of points at any time during the Program.
13. Only the Enrolees validly presenting their Identity Cards and Redemption Codes will be entitled to receive their prizes. Prizes must be redeemed from the respective location and on the respective dates, as specified on the notification received via web.
14. Enrolees shall not be entitled to try on the prizes they have redeemed at the location from which they may collect such prizes in terms of clause 10 above.
15. The Organisers shall not be liable for any delays in the delivery of prizes to winning Participants.
16. The Organisers are not responsible for any incorrect or inaccurate information supplied by Enrolees while participating in the Sprite Zone Promotion.
17. All questions or disputes regarding eligibility of the Sprite Zone Promotion, collecting or redemption of points, or an Enrolee’s compliance with these Terms and Conditions will be resolved by The Organisers in its sole discretion.
18. An Enrolee’s continued participation in the Sprite Zone Promotion constitutes the Enrolee’s acceptance of any changes to the full Terms and Conditions. 15. Only the Enrollees validly presenting their Identity Cards and Redemption Codes will be entitled to receive their Items. Items must be redeemed from the Things, St.Julians by latest Wednesday 28th April 2010 at 5pm.
16. The Organisers shall not be liable for any delays in the delivery of The Prodigy Promotion Prizes to winning The Prodigy Promotion Enrolees.
17. The Organisers are not responsible for any incorrect or inaccurate information supplied by Enrolees while participating in The Prodigy in concert Promotion.
18. The Organisers shall not be held liable in any way, for any claims arising out of or relating to the use of any of The Prodigy Promotion Prizes, including but not limited to claims for personal injury or damage caused to The Prodigy Promotion winners or any other third party. Each The Prodigy Promotion Prize shall be regulated by the terms and conditions applicable to such prize or award and shall form the basis of the relationship between The Prodigy Promotion and the third party organising the event. It is agreed that the Organiser shall have no responsibility vis-a-vis The Prodigy Promotion winners with respect to The Prodigy Promotion Prizes and their use. Furthermore, The Prodigy Promotion winners hold and continue to hold the Organiser free and harmless against all and any claims of any person in respect of The Prodigy Promotion Prizes and their use. The Prodigy Promotion winners are urged to carefully review any terms and conditions of use of any The Prodigy Promotion Prizes issued by the
third party organising or launching or otherwise providing such prize and/or award.
19. The Prodigy Ticket is not transferable. Lost tickets will not be replaced. The organisers will not assume responsibility of civil or criminal nature or for any reason beyond their control. Id Card might be requested at the door. The management reserves the right to refuse entry.

MyCoke Vodafone Club Gifts
1. The ‘MyCoke Vodafone Club April 2010 Gifts’ is a joint offer between Vodafone Malta Ltd and The General Soft Drinks Co. Ltd. (hereinafter referred to as ‘the Offer’) and is part of the MyCoke Star Points Campaign.
2. This Offer will be launched on the 19th of April 2010 and Customers may redeem their MyCoke points until the 31 May 2010 or until stocks last.
3. Customers can redeem their MyCoke points either for a bundle of 30 minutes talk time to Vodafone Customers or for a bundle of 60 SMS to Vodafone Customers. The bundles have a 30 day time window.
4. Only Vodafone Customers on a Prepaid Connection who register with the MyCoke Vodafone Club shall be eligible for these bundles. If non–Vodafone customers would like to register with this Club, such customers may only do so if they subscribe to Vodafone’s prepaid services.
5. Upon redemption from the MyCoke portal, Customers will be given a Code through the Portal. The Customer will present this code at one of the Vodafone retail outlets. A Vodafone retail representative will assign the bundle to the Customer.
6. Customers will be notified via SMS when the bundle is allocated.
7. All other services, including MMS and Data shall be charged and/or deducted from the Customer’s credit as per existing tariff plan.
8. Any call made or SMS sent to any foreign Vodafone network not being that of Vodafone Malta shall not be covered by this Offer and shall be charged according to the Customer’s existing tariff plan.
9. All SMS granted as per Term 3 above cannot be used whilst roaming.
10. This Offer is not available to Customers of foreign Vodafone networks availing of the Pre-Pay Roaming Top-Up (PPRTU).
11. Vodafone general prepaid terms and conditions and any other relevant Vodafone terms and conditions shall apply.
12. All customers are advised to visit our website (www.vodafone.com.mt), call Customer Care on 247, send an email on customerservice.malta@vodafone.com or visit our retail outlets, to learn more about this Offer.
13. FAIR USAGE POLICY: All Vodafone services are subject to Vodafone’s fair use policy. If, in the reasonable opinion of Vodafone, the customer’s use is excessive and/or the free SMS and/or free units threshold/s is/are exceeded, Vodafone may ask the customer to moderate his/her usage. If after Vodafone has informed the customer to moderate his/her usage, the customer fails to do so, Vodafone reserves the right to charge the customer for the excessive element of his/her usage, or to suspend or terminate the Customer’s service in accordance with his/her Tariff plan. Furthermore, Vodafone reserves its right to suspend or terminate the customer’s service if he/she abuses of the service and/or uses it in a way for which it is not intended.

Vodafone reserves the right to suspend indefinitely or for a definite period, amend/alter or terminate these Tariffs and these Terms and Conditions at any time (collectively referred to as the ‘Modifications’) by giving its Customers a 30 day prior written notice with the proposed amendments/alterations or stating the reason for the suspension and/or termination thereof.
15. Should customers disagree with the Modifications during the time-period stipulated in Term 27 above, Customers shall have the right to opt out of this Tariff without incurring any penalty whatsoever by informing Vodafone of their decision to this effect. In default Customers shall be deemed as having accepted the Modifications and may incur penalties should they decide to opt out upon the expiration of the time-period.

9. The items that may be redeemed shall be subject to availability by the Organisers.
Redemption of Star Points and Prizes
10. Participants having collected sufficient coloured points in their account to redeem a particular item found in the Fanta Splash, may proceed to redeem the item against their star points using the REDEEM NOW function. Each Enrolee may only use the REDEEM NOW function for a maximum of one prize in the Fanta Splash Promotion every 20 days.
11. 18. Splash and Fun Day Tickets will be dated. Upon redemption, consumers must choose the particular date in which they would like to utilise their Free Day Ticket. Once the ticket is redeemed it cannot be transferred for us on another day.
19. Splash and Fun Day Tickets will include a free day ticket to Splash and Fun Water Park, which includes free use of all attractions, one umbrella and one sun bed (subject to availability) and excludes food and drink costs.
Delivery and Collection of Items
20. Participants must collect the redeemed tickets themselves from the location indicated by the Organiser, (Splash and Fun Water Park) at the date and times stipulated by the Organisers and notified to the Participants.
21. When collecting their items from the respective outlet, Participants must present their Identity Cards and Redemption Codes at the respective location and on the respective dates, as specified on the notification received confirming redemption of the items.
General Terms and Conditions
22. The Competition will be run in accordance with these terms and conditions and in accordance with the Program’s T&Cs, subject to any amendment which may by made from time to time by the Organisers at their sole discretion.
23. The participants of the Competition must abide with these terms and conditions and with the Program’s T&Cs.
24. These terms and conditions, as set out herein, are not subject to amendment or counter-offer, except as set out herein.
25. The Organisers reserve the right to cancel this Competition in its entirety without notice to Participants and without incurring liability

Except as otherwise provided in these terms and conditions, the Organisers will only disclose personal details if and when it is required to do so under any applicable law. Participants have the right to access data which the Organisers hold about them, and, where applicable, the right to ask for a rectification or erasure of such data.
29. The Organisers shall not be held liable in any way, for any claims arising out of or relating to the use of any of the items redeemed through this Competition, including but not limited to claims for personal injury or damage caused to the Participants or any other third party. Furthermore the Participants hold and continue to hold the Organisers free and harmless against all and any claims of any person in respect of the Fanta Splash Prizes and their use. The Organisers are not liable for any damage suffered by any Participant due to the non observance of these Terms and Conditions.
30. The Organisers shall not be liable for any delays in the delivery of the items to Participants.
31. The Organisers are not responsible for any technical error that may occur during the Competition. This includes, but is not limited to, any omission, interruption, deletion, defect or delay in operation or transmission or failure of any telephone, mobile or satellite network.
32. The Organisers are not responsible for any tax implications that may arise from winning any prize pursuant to the Competition. Participants should seek independent financial advice about such matters.
33. a) any and all disputes, claims, and causes of action arising out of or connected with this Competition, of any prizes obtained through the Competition, shall be resolved individually, without resort to any form of cumulative or group action and exclusively by the Courts of Malta;
b) any and all claims, judgments and Prizes shall be limited to actual out-of-the-pocket costs incurred, including costs associated with participating in this Competition, but in no event attorneys’ fees; and
c) under no circumstances will the Participant be permitted to seek recovery for, and the Participant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses and waives any and all rights to have damages multiplied or otherwise increased.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Competition T&Cs, or the rights and obligations of the Participant and Organiser in connection with the Competition, shall be governed by, and construed in accordance with, the laws of Malta without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than Malta.

These Competition T&Cs constitute the entire agreement between the Participants and Organiser pertaining to the subject matter herein and supersedes all prior or other arrangements, understandings, negotiations and discussions, whether oral or written. No waiver of any of the provisions of these Competition T&Cs shall be deemed or shall constitute a waiver of any other provisions hereof (whether or not similar), nor shall waiver constitute a continuing waiver unless otherwise expressly provided.
